1. Promotional giveaways only

Every giveaway, drawing, challenge, leaderboard reward or promotion run by Hyphonix (a "Giveaway") is offered purely for promotion and entertainment. Taking part does not create a job, a partnership, an agency relationship or a contract for services between you and Hyphonix.

No reward is owed to anyone until it has actually been delivered to them. We may choose, at our discretion, not to hand out a reward in full or in part. Unless a specific Giveaway says otherwise, you never have to buy anything or place a wager to enter.

2. Who can take part

You must be at least 18, or the age of majority where you live if that is higher. Giveaways are void anywhere they are forbidden or restricted by law, and it is up to you to make sure that entering is legal where you are.

We may check the identity, age, location and entry details of any participant at any point — before, during or after a Giveaway. If anything you give us is missing, wrong, unverifiable, misleading or looks fraudulent, your entry can be voided and a reward can be delayed, reduced, held back or taken away.

We can refuse entry, disqualify anyone and withhold any reward at our discretion, at any time, with or without notice. Entering never guarantees that you will be picked or paid.

3. Fair play

We may withhold, reduce or reverse any reward if we believe someone has done any of the following:

• used bots, scripts, automation or faked activity;
• used alternate, shared or duplicate accounts;
• given false, altered or impersonated information;
• used a VPN, proxy or other tool to get around the eligibility rules;
• exploited a bug, loophole or technical glitch;
• colluded with others to game entries or voting;
• harassed or abused our staff, moderators or community.

Trying to work around these Terms can lead to permanent disqualification from current and future Giveaways and the loss of any pending or past reward.

4. Our decisions are final

Everything we decide about a Giveaway — eligibility, verification, who qualifies, reward amounts, how and when payouts happen, and disqualifications — is final and made at our discretion. There is no appeal or outside review of the outcome.

5. Reward farming

Giveaways are meant for people who are genuinely part of the Hyphonix community. We may, at our discretion, treat someone as a reward farmer — for example, someone who seems to show up only to collect rewards, who has little or no real engagement with our streams or community, who hops between unrelated creators' giveaways, or who repeatedly claims without taking part.

Anyone we identify this way may have their entries voided, their rewards held back or cancelled, and their eligibility revoked, and may be shut out of future Giveaways. Declining to pay a reward farmer is not a breach of anything and gives rise to no claim.

6. Changes, pauses and cancellation

We may change, pause, postpone, restart or cancel any Giveaway, prize pool, payout schedule or these Terms at any time and for any reason, including fraud prevention, technical problems, legal reasons, sponsor changes or operational needs. If you keep taking part after a change, you accept it.

7. Technical and delivery limits

We are not responsible for entries, claims, messages or payouts that are late, lost, misdirected, incomplete or fail because of technical faults, third-party services, platform outages, account problems, out-of-date information, wallet issues, exchange or network downtime, blockchain congestion or connection trouble.

Giveaways are not sponsored, endorsed, run by or associated with Kick, Twitch, Rainbet or any other platform, and those platforms take on no responsibility for them.

8. Your username, likeness and submissions

By taking part, you give Hyphonix a worldwide, royalty-free, perpetual and transferable licence to use, show, broadcast, share and adapt your public or submitted username, your chat messages, and any text or images you choose to send in connection with a Giveaway, for promotion and for running the Giveaway — on streams, websites, social media, leaderboards and similar.

You confirm that anything you submit is yours to submit and does not infringe anyone else's rights, and you waive any right to review or approve how it is used.

9. Rewards and payouts

Rewards may be paid in cash-equivalent form or in cryptocurrency, depending on the Giveaway. Where a reward is paid in cryptocurrency, you accept that:

• crypto values move and can change before, during or after a payout;
• blockchain transactions usually cannot be reversed once sent;
• you are responsible for giving a correct wallet address and choosing the right network;
• you are not located in, or a resident of, any sanctioned or restricted region (including those listed by the U.S. Office of Foreign Assets Control), and are not on any sanctions or denied-persons list;
• we may ask for extra verification first and may decline to pay where doing so could break the law.

Any taxes, fees, network costs, conversion costs or reporting tied to a reward are yours to handle. We do not give tax, legal or financial advice, and we may withhold or report payouts where the law requires it.

10. Information we collect

When you take part in a Giveaway or use the Hyphonix site, we may collect and store the information you give us, information created as you use the site, and certain technical and security signals. We use it to run Giveaways, confirm eligibility, detect and stop bots, fraud and abuse, contact you about your entry or reward, meet legal obligations, and keep the site working and secure.

We do not sell your information.

11. Sponsors and third parties

Hyphonix is sponsored by Rainbet and encourages signing up to Rainbet with code HX, but this website is independent and is not endorsed by, operated by or affiliated with Rainbet, Kick, Twitch or any other third party. We are not responsible for third-party platforms, services or products, and any dealings you have with them are strictly between you and them.

12. Responsible gambling

Some of what this site links to involves legal-age gambling. Gambling can be addictive and is not right for everyone. If gambling may be a problem for you or someone you know, please reach out to a qualified gambling-support service in your country. Only ever play within your means. Nothing here or in any Giveaway is an inducement to gamble.

13. Indemnification

You agree to defend, indemnify and hold harmless Hyphonix and its representatives, affiliates, contractors, sponsors and partners from any claims, damages, losses, liabilities and costs (including reasonable legal fees) arising from your participation in a Giveaway, your breach of these Terms, your breaking of any law or someone else's rights, or any content you submit.

14. Limitation of liability

To the fullest extent the law allows, we and our representatives and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or opportunity, arising from a Giveaway, these Terms or your participation — even if we were told such damages were possible.

To the fullest extent the law allows, our total liability connected to a Giveaway will not be more than the greater of the actual value of the reward delivered to you in that Giveaway, if any, or one hundred U.S. dollars (USD $100). Where a jurisdiction does not allow some of these limits, they apply as far as that jurisdiction permits.

15. Disputes and class-action waiver

We operate globally and do not name a single governing jurisdiction in these Terms. The aim is for any dispute to be handled efficiently and on an individual basis, wherever either side is located.

To the fullest extent the law allows, any dispute arising out of these Terms or a Giveaway will be settled by final and binding individual arbitration, conducted in English. The parties will first try in good faith to agree on a neutral arbitration provider; if none is agreed within thirty (30) days of written notice of the dispute, it will be administered by a recognised international arbitration body we reasonably choose, under that body's current rules.

You and we each give up any right to a jury trial and any right to bring or join a class, collective or representative action. Disputes must be brought on an individual basis only.

16. Time limit for claims

Any claim connected to a Giveaway or these Terms must be brought within one (1) year of when it arose, or it is permanently barred, as far as the law allows.

17. General

These Terms, together with any rules posted for a specific Giveaway, are the whole agreement between you and us on this subject and replace anything said before.

If any part is found invalid, it will be narrowed just enough to be enforceable and the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not transfer these Terms without our written consent; we may transfer them freely.

We are not liable for delays or failures caused by events beyond our reasonable control. The sections on fair play, content and likeness, indemnification, limitation of liability, disputes, time limits and these general provisions survive after these Terms end. Headings are for convenience only.
